Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Spatialize Geosurvey mobile application (the "App"), operated by Spatialize Systems ("we", "us", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

1. Subscription and Billing

1.1 Free Trial

Spatialize Geosurvey offers a 14-day free trial for new subscribers. During the trial period, you have full access to all features. You will not be charged until the trial period ends.

1.2 Subscription Plans

• Monthly Plan: Billed monthly. Auto-renews unless cancelled.
• Yearly Plan: Billed annually at a discounted rate. Auto-renews unless cancelled.

1.3 Billing and Renewal

• Subscriptions are processed through Google Play's billing system.
• Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date.
• You can manage or cancel your subscription through your Google Play account settings.

1.4 Cancellation

• You may cancel your subscription at any time through your Google Play account.
• Cancellation takes effect at the end of the current billing period. You will continue to have full-version access until the period ends.
• We do not provide refunds for partial billing periods.

2. License and App Usage

2.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal or professional surveying activities.

2.2 Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App.
• Use the App for any illegal or unauthorized purpose.
• Attempt to circumvent the platform store's in-app purchase validation or any subscription-entitlement checks built into the App.
• Distribute, sublicense, rent, lease, or sell the App or any part thereof.
• Use automated scripts or tools to interfere with the App's normal operation.

2.3 Subscription & Device Coverage

Your subscription is tied to your Google account, not to a specific device. You may install the App and access the full version on any Android device signed in to the same Google account, subject to Google Play's own multi-device rules.

3. User Data and Content

3.1 Data Ownership

You retain full ownership of all survey data, coordinates, photos, videos, and other content you create using the App ("User Content"). We claim no ownership rights over your User Content.

3.2 Data Responsibility

You are solely responsible for:

• The accuracy and legality of your survey data.
• Obtaining any necessary permissions or consents for data collection at survey sites.
• Backing up your data. While we take care to ensure the App functions correctly, we are not responsible for data loss due to device failure, uninstallation, or user error.

3.3 Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

4. Accuracy and Limitations

4.1 GPS Accuracy

The App relies on your device's GPS hardware and satellite signals. GPS accuracy can be affected by terrain, buildings, atmospheric conditions, and device quality. We do not guarantee specific accuracy levels and recommend verifying critical measurements with professional-grade equipment.

4.2 Map Data

Base maps are provided by OpenStreetMap and other third-party sources. Map accuracy, completeness, and availability are outside our control.

4.3 No Warranty

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Spatialize Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities.
• Errors or inaccuracies in survey data.
• Personal injury or property damage resulting from use of the App.
• Any other damages arising out of or in connection with your use of the App.

6. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
