Terms of Service
Last updated: 23 September 2026
Please read these Terms of Service ("Terms") before using the Spatialize Tavak mobile application (the "App"), which is made and run by Spatialize Systems ("we", "us", "our").
You may use the App only if you accept these Terms and keep to them. They apply to everyone who uses the App. Using it means you are bound by them. If you disagree with any part of them, you may not use the App.
1. Buying, subscribing and billing
1.1 The free version
Spatialize Tavak can be installed and used free of charge. The free version gives you one survey session and up to 100 objects, meaning points, lines, polygons, and photos or videos that stand on their own. They are counted when they are created on the device. Every other feature is included, the export among them. The full version removes those two limits. There is no trial on a clock.
1.2 What you can buy
- Yearly plan: billed once a year, and renews itself unless you cancel.
- Monthly plan: billed each month, and renews itself unless you cancel.
- Lifetime: a one-off purchase, no longer on sale. If you bought one before it was withdrawn, it stays yours: every update to Tavak 1.x, on the phone you registered (section 2.3), with no subscription and nothing to renew. A future major version, 2.0, would be a new purchase, offered to lifetime holders at a discount.
Every plan gives you the same full version, on one phone at a time. Current prices are shown in the app and on Google Play.
1.3 Billing and renewal
- Subscriptions go through Google Play's billing system.
- Your subscription renews itself at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- You can manage or cancel it from your Google Play account settings.
1.4 Cancellation
- You can cancel whenever you like, from your Google Play account.
- Cancelling takes effect at the end of the current billing period, and you keep the full version until then.
- We do not refund part of a billing period. A refund on the lifetime purchase follows Google Play's refund policy.
- When a subscription ends, or a purchase is refunded, the App goes back to the free version. Everything you captured stays on your phone and stays readable, editable and exportable. The free version limits only what you can create from then on.
1.5 Working for an organisation
An organisation that runs its own Tavak Server can enrol phones into its fleet. Enrolling means scanning an enrolment code and agreeing to what the screen tells you the organisation will receive. Once you have:
- The seat stands in for a purchase. While your phone holds a seat on your organisation's licence, the full version is unlocked without a subscription of your own. You pay us nothing and we bill you nothing.
- The arrangement is between you and your organisation. They decide who gets a seat, what the phone reports, and which settings are locked. We are not a party to it, and we neither host nor read what their server holds. See section 5 of the Privacy Policy.
- When the seat ends, whether because you left or because the organisation released the phone, the App falls back to whatever you hold in your own right: your subscription if you have one, otherwise the free version. Everything you captured stays on your phone.
- A subscription of your own is untouched by holding a seat. It keeps running and keeps its renewal date. It simply is not the thing unlocking the App while the seat lasts.
2. Licence and use of the App
2.1 The licence we grant
So long as you keep to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App for your own surveying work, personal or professional.
2.2 What you may not do
You agree not to:
- Modify, reverse engineer, decompile, or disassemble the App.
- Use the App for anything illegal or unauthorised.
- Try to get around the platform store's in-app purchase validation, the one-phone registration, or any other entitlement check built into the App.
- Distribute, sublicense, rent, lease, or sell the App or any part thereof.
- Use scripts or tools to interfere with how the App normally works.
2.3 One phone at a time
Full version: one licence, one phone at a time. Moving to a new phone is one tap; you can move once every 30 days. Running Tavak on several phones at once needs a licence for each.
- Your purchase belongs to your Google account, and Google Play will restore it on any phone signed in to that account. The full version itself is registered to one phone. After a purchase or a restore, the App sends our licence server a hashed identifier of the phone along with the purchase token, and the server records that phone as the one holding the licence.
- Moving it: restore the purchase on a different phone and the App offers to move the licence across. The move replaces the previous phone, which goes back to the free version. A licence can be moved once every 30 days. If you still have the old phone in your hand, you can release it from Settings → Full Version at any time, with no waiting.
- Lost or reset phones: a factory reset makes a phone look new, so moving the licence to it counts as a move. If a phone is lost or broken inside the 30-day period, write to us and we will release it.
- Checks: the App confirms the registration with our licence server about once every 30 days. If it cannot reach the server, the full version carries on for another 30 days, after which it pauses until the App is online again. The free version never contacts the licence server at all.
- If we ever stop: should Spatialize Tavak be discontinued, we will publish a final build of the 1.x line that does not need the licence server, so a lifetime purchase keeps working on the phone that holds it.
3. Your data and content
3.1 Who owns it
You keep full ownership of every survey, coordinate, photo, video and anything else you create with the App ("User Content"). We claim no ownership of it whatsoever.
3.2 What you are responsible for
You alone are responsible for:
- Whether your survey data is accurate, and whether collecting it was lawful.
- Getting whatever permissions or consents are needed to collect data at a site.
- Backing up your data. We do our best to make the App work properly, but we are not responsible for data lost to a device failure, an uninstall, or a mistake.
3.3 Privacy
Your use of the App is also governed by our Privacy Policy, which sets out what information is handled and what happens to it.
4. Accuracy, and what the App cannot promise
4.1 GPS accuracy
The App depends on your device's GPS hardware and on the satellite signal it can get. Terrain, buildings, the weather and the quality of the phone itself all affect that. We do not guarantee any particular accuracy, and we recommend checking any measurement that really matters against professional survey equipment.
4.2 Map data
The built-in basemaps come from OpenFreeMap, drawn from OpenStreetMap data. Any other basemap comes from a third party you chose yourself. How accurate, how complete and how available that map data is are all outside our control.
4.3 No warranty
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5. Limitation of liability
To the maximum extent permitted by applicable law, Spatialize Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Lost profits, lost data, or lost business.
- Errors or inaccuracies in survey data.
- Personal injury or damage to property arising from use of the App.
- Any other damages arising out of or in connection with your use of the App.
6. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the App will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. Changes to these Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
